The NDIS Commission is seeking feedback on proposed changes to the NDIS Act through its consultation paper for Bill No. 2. These changes aim to strengthen quality standards, participant safeguards, and the compliance framework, addressing findings from its own inquiries, complaints data, and the Disability Royal Commission.

The paper outlines 10 key measures, including introducing statutory duties for NDIS providers and key personnel to ensure accountability and participant safety. Higher penalties for breaches, anti-promotion orders to curb misleading advertising, and new criminal offences are proposed to deter non-compliance. Additionally, banning powers would be extended to advisors and consultants who act against the scheme’s integrity.

Technical amendments include requiring providers to store information within Australia and shortening response times for compliance requests when participant safety is at risk. Public feedback is crucial to refining these proposals.
